What is mediation in family law?

The end of a marriage will be a distressing and upsetting time for everyone involved. With emotions running high it can be difficult to reach an equitable agreement with the other party. Important decisions must be made on issues including financial and child arrangements. Unfortunately, when communication and trust have gone, many separating couples struggle to reach an agreement.
Mediation is an attempt to open lines of communication and help couples come to an agreement that would not have been possible by themselves. Our mediation process, creates a safe space for all parties to discuss important issues with the help of a specialist family law mediator.
We find that a mediator can often bring both parties together, as it helps each side understand the other and move forward toward a successful resolution without the need for court action or acrimonious litigation.

Such an approach has a host of benefits, including:

  • Minimising costs: By resolving all issues following a separation we can help you reduce costs and avoid the expensive prospect of court proceedings.
  • Reduce stress: Without mediation, it can be impossible for families to establish lines of trust or communication. It can add to the stress and acrimony of the separation and be harmful to the well-being of children.
  • Keeping control: Working together with a mediator helps you retain control over the separation. If your cases go to court, everything will be in the hands of legal professionals. The only way to retain control of post-separation arrangements is to reach an agreement with the other party.
  • Focus on children: In an acrimonious divorce, children can often be caught in the crossfire. Mediation helps you keep the needs of children at the heart of the decision-making process. Our team will always include the wants and wishes of the children, where appropriate, in all agreements to ensure everyone finds a way to maintain relationships even after separation.
  • Explore options: With the help of a family law mediator, you and your family can explore all options before making a final decision. Whether it’s splitting finances or arranging child custody, you can test out the viability of all options and ensure all decisions are workable for everyone.
